Gayrimenkul m\u00fclkiyetinin konusu, kazan\u0131lmas\u0131, kayb\u0131, emlak, gayrimenkul ta\u015f\u0131nmaz al\u0131m sat\u0131m\u0131 ile kiralama, imar ve in\u015faat projelerinin kanuna uygun olup olmad\u0131\u011f\u0131n\u0131n denetlenmesi, yap\u0131lacak i\u015flemlerde gerekli izin ve ruhsatlar\u0131n al\u0131nmas\u0131, edinilmi\u015f tapular\u0131n iptali veya tapuyu edinmek i\u00e7in a\u00e7\u0131lan tapu tescil davas\u0131 dahil, her t\u00fcrl\u00fc kira s\u00f6zle\u015fmelerinin d\u00fczenlenmesi, gayrimenkul m\u00fclkiyetinin konusunu arazi, tapu k\u00fct\u00fc\u011f\u00fcnde ayr\u0131 sayfay\u0131 kaydedilen ba\u011f\u0131ms\u0131z ve s\u00fcrekli haklar, kat m\u00fclkiyeti k\u00fct\u00fc\u011f\u00fcne kay\u0131tl\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmler gibi konular\u0131n yan\u0131 s\u0131ra, devir s\u00f6zle\u015fmeleri, kat kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmeleri, rehin ve ipotek tesisi, tapu i\u015flemleri ve ayni hak tesis i\u015flemlerinin takibi gibi alanlarda hukuki konu ve i\u015flemler gayrimenkul hukukunun konular\u0131ndan sadece bir ka\u00e7\u0131d\u0131r.<\/p>\n<p>Gayrimenkul sekt\u00f6r\u00fcn\u00fcn geni\u015fli\u011fi, gayrimenkul hukukunun ve davalar\u0131n\u0131n karma\u015f\u0131k, \u00e7e\u015fitli ve geni\u015f kapsaml\u0131 olmas\u0131, gayrimenkul konulu t\u00fcm dava, i\u015f, i\u015flem, s\u00f6zle\u015fme, yat\u0131r\u0131m, al\u0131m-sat\u0131m, tescil ve bunlardan kaynakl\u0131 gayrimenkul davalar\u0131n\u0131n titizlik ve bilgiyle y\u00fcr\u00fct\u00fclmesini gerekli ve zorunlu k\u0131lar. Bu gereklilik ve zorunlulu\u011fa \u00f6nem verilmezse, telafisi m\u00fcmk\u00fcn olmayan zararlar\u0131n ve hak kay\u0131plar\u0131n\u0131n muhtemel olmas\u0131 nedeniyle, gayrimenkul (ta\u015f\u0131nmaz) hukuku davalar\u0131 alan\u0131nda uzman ve deneyimli avukatlardan hukuki destek al\u0131nmas\u0131, gayrimenkul davalar\u0131nda ba\u015far\u0131l\u0131 avukatl\u0131k hizmeti almak isteyen ki\u015filer i\u00e7in hayati \u00f6neme sahiptir.<\/p>\n<p><strong>Ta\u015f\u0131nmaz Mal Komisyonu<\/strong><\/p>\n<p>Ta\u015f\u0131nmaz Mal Komisyonu, Avrupa \u0130nsan Haklar\u0131 Mahkemesi&#8217;nin Xenides-Arestis &#8211; T\u00fcrkiye davas\u0131ndaki kararlar\u0131na uygun olarak, Ta\u015f\u0131nmaz M\u00fclkiyet Kanunu (say\u0131 67\/2005) kapsam\u0131nda kurulmu\u015ftur. Bu Komisyonun amac\u0131, Kuzey K\u0131br\u0131s&#8217;ta terk edilmi\u015f m\u00fclklerle ilgili taleplere kar\u015f\u0131 etkili bir i\u00e7 hukuk yolu olu\u015fturmakt\u0131.<\/p>\n<p>Avrupa \u0130nsan Haklar\u0131 Mahkemesi, Demopoulos ve Di\u011ferleri &#8211; T\u00fcrkiye davas\u0131n\u0131n kabul edilebilirli\u011fine ili\u015fkin 1 Mart 2010 tarihli karar\u0131yla 67\/2005 say\u0131l\u0131 Kanun&#8217;un etkili bir hukuk yolu sa\u011flad\u0131\u011f\u0131na h\u00fckmetmi\u015f ve ba\u015fvuranlar\u0131n i\u00e7 hukuk yollar\u0131n\u0131n t\u00fcketilmedi\u011fi y\u00f6n\u00fcndeki \u015fik\u00e2yetlerini reddetmi\u015ftir.<\/p>\n<p>Ta\u015f\u0131nmaz Mal Komisyonu, 67\/2005 say\u0131l\u0131 yasa h\u00fck\u00fcmlerine g\u00f6re iade, tazminat ve takas taleplerini inceliyor. G\u00f6r\u00fc\u015fleri, 1977-1979 Y\u00fcksek D\u00fczeyli Anla\u015fmalar\u0131n ortak unsurlar\u0131 olan iki b\u00f6lgelilik ve iki toplumluluk ilkelerinin yan\u0131 s\u0131ra Birle\u015fmi\u015f Milletler taraf\u0131ndan K\u0131br\u0131s Sorununun \u00e7\u00f6z\u00fcm\u00fcne y\u00f6nelik haz\u0131rlanan planlara dayanmaktad\u0131r. K\u0131br\u0131s T\u00fcrk Toplumunun haklar\u0131na halel getirmeksizin m\u00fclk sahiplerinin me\u015fru taleplerini kar\u015f\u0131lamay\u0131 ama\u00e7lamaktad\u0131r.<\/p>\n<p>15 Nisan 2013 tarihi itibariyle Komisyona 4795 ba\u015fvuru yap\u0131lm\u0131\u015ft\u0131r. Komisyon ba\u015fvuru sahiplerine 108.183.423.- GBP tazminat \u00f6demi\u015ftir. Ayr\u0131ca iki davada takas ve tazminat, bir davada iade, be\u015f davada ise iade ve tazminat karar\u0131 verildi. K\u0131br\u0131s Sorunu \u00e7\u00f6z\u00fcld\u00fckten sonra bir davada iade karar\u0131 vermi\u015f, bir vakada da k\u0131smi iade karar\u0131 vermi\u015f.<\/p>\n<p>Ta\u015f\u0131nmaz Mal Komisyonu, m\u00fclk iddialar\u0131na kar\u015f\u0131 adil, h\u0131zl\u0131 ve etkili bir \u00e7\u00f6z\u00fcm olmay\u0131 ama\u00e7lamaktad\u0131r. \u00fclkelerden (T\u00fcrkiye gibi) gelenler en fazla \u00fc\u00e7 daire sat\u0131n alabilir.<\/li>\n<li>3.300m\u00b2&#8217;ye kadar arazi \u00fczerinde bir m\u00fcstakil ev.<\/li>\n<\/ul>\n<\/li>\n<li>Yabanc\u0131lar, ortak tapular\u0131 bir m\u00fcstakil ev veya daire olmad\u0131k\u00e7a sat\u0131n alamazlar ve sadece \u00fc\u00e7 yabanc\u0131 ortak bir tapu
