Bir i\u015f ili\u015fkisinin \u0130\u015f Hukuku kapsam\u0131nda yer alabilmesi i\u00e7in, i\u015f g\u00f6ren ki\u015finin bu i\u015fi ba\u015fkas\u0131na ba\u011f\u0131ml\u0131 olarak ve \u00fccret kar\u015f\u0131l\u0131\u011f\u0131nda yap\u0131yor olmas\u0131 gerekir. \u0130\u015f Hukukunu, i\u015f s\u00f6zle\u015fmesine dayanarak \u00fccret kar\u015f\u0131l\u0131\u011f\u0131 i\u015fveren i\u00e7in ve ona ba\u011fl\u0131 olarak \u00e7al\u0131\u015fan i\u015f\u00e7i ile bunlar\u0131n aras\u0131ndaki i\u015f ili\u015fkilerini d\u00fczenleyen hukuk dal\u0131 olarak tan\u0131mlanabilir. Say\u0131sal olarak tek ki\u015fi olan i\u015f\u00e7i ile i\u015fveren aras\u0131ndaki i\u015f s\u00f6zle\u015fmesinin kurulmas\u0131 sonras\u0131ndaki s\u00f6zle\u015fme an\u0131ndan s\u00f6zle\u015fme feshine kadar ya\u015fanacak taraflar aras\u0131nda ya\u015fanacak her hukuki ili\u015fki, Bireysel \u0130\u015f Hukukunun konusunu olu\u015fturur. \u0130\u015f s\u00f6zle\u015fmesinin kurulmas\u0131, bu s\u00f6zle\u015fmeden kaynaklanan hak ve y\u00fck\u00fcml\u00fcl\u00fcklerin belirlenmesi, yerine getirilmesi, i\u015f s\u00f6zle\u015fmesinin devam\u0131 s\u0131ras\u0131nda \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131n d\u00fczenlenmesi, \u00e7al\u0131\u015fma ve dinlenme s\u00fcreleri, i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi, i\u015f\u00e7inin \u00e7al\u0131\u015fmas\u0131, i\u015f s\u00f6zle\u015fmesinin sona ermesi ve sona ermesinin sonu\u00e7lar\u0131 gibi b\u00fct\u00fcn i\u015f s\u00f6zle\u015fmesinin kurulmas\u0131ndan feshi de dahil t\u00fcm s\u00fcre\u00e7 Bireysel \u0130\u015f Hukukunun konusu i\u00e7erisinde yer al\u0131r.<\/p>\n<p>\u0130\u015f\u00e7i-i\u015fveren haklar\u0131n\u0131 korumay\u0131 ama\u00e7layan 22\/92 say\u0131l\u0131 \u0130\u015f Yasas\u0131, s\u00f6z konusu i\u015f\u00e7i veya i\u015fverenin hakl\u0131 bir fesih nedeni oldu\u011fu zaman hem i\u015f\u00e7inin hem de i\u015fverenin haklar\u0131n\u0131 korumaktad\u0131r. \u0130\u015f Yasas\u0131\u2019n\u0131n 15. maddesine g\u00f6re hizmet akdinin i\u015fveren taraf\u0131ndan feshedilebilmesi i\u00e7in feshin yaz\u0131l\u0131 yap\u0131lmas\u0131 ko\u015fuldur.<\/p>\n<p>\u0130\u015f Hukukunun bir dal\u0131 olan toplu i\u015f hukuku, sosyal devlet anlay\u0131\u015f\u0131n\u0131n bir gere\u011fi olarak mevzuat\u0131m\u0131zda yer alan ve i\u015f ili\u015fkilerinin taraflar\u0131n\u0131n toplu bir \u015fekilde hareket edebilmelerine olanak sa\u011flayan bir hukuk dal\u0131 olup, konusunu birden fazla i\u015f\u00e7inin kolektif d\u00fczeyde ayn\u0131 i\u015fverenle i\u015f ili\u015fkileri olan toplu i\u015f s\u00f6zle\u015fmeleri olu\u015fturur. Taraflar\u0131ndan en az birisinin mesleki kurulu\u015fu olan sendika oldu\u011fu i\u015f ili\u015fkileri, Toplu \u0130\u015f Hukukunun konusunu olu\u015fturur. Sendika ile \u00fcyeleri aras\u0131ndaki ili\u015fki de Toplu \u0130\u015f Hukukunun kapsam\u0131 aras\u0131nda yer al\u0131r. \u0130\u015f\u00e7i ve i\u015fveren sendikalar\u0131n\u0131n kurulu\u015fu, organlar\u0131, faaliyetleri, sendikalara \u00fcyelik, toplu i\u015f s\u00f6zle\u015fmesinin meydana getirilmesi, toplu i\u015f uyu\u015fmazl\u0131klar\u0131n\u0131n bar\u0131\u015f\u00e7\u0131 yollarla \u00e7\u00f6z\u00fcmlenmesi, sendika ile \u00fcyeleri aras\u0131ndaki ili\u015fkileri, grev ve lokavta ba\u015fvurulmas\u0131 gibi konular Toplu \u0130\u015f Hukukunun konular\u0131 aras\u0131ndad\u0131r.
